Who we are
This website is operated by Montenica Pty Ltd, ACN 700 537 604, ABN 99 700 537 604, of Shop 2/290 Boundary Street, Spring Hill QLD 4000, Australia.
In this policy, “we”, “us” and “our” mean Montenica Pty Ltd. “You” means anyone who visits this site, contacts us, or engages us.
We handle personal information in line with the Australian Privacy Principles. For privacy questions, write to admin@montenica.com.
What we collect
When you send an enquiry. Your name, email address, your role at your studio, your studio’s website, and anything you choose to tell us about what you are looking for.
When you correspond with us. The content of your emails and any documents you send.
When you become a client. Your business name, ABN, business address, billing contact, the people you nominate to approve work, and the brand materials, photography, project information and internal documents you supply for the engagement.
When we meet. We record client meetings held over video. We tell you at the start of every meeting, before recording begins.
When you use this site. Basic analytics collected by our website platform, covering pages viewed, approximate location by country or city, device type and referring source. This is aggregated and does not identify you.
When we contact you first. Where we approach your studio directly, we hold your business contact details and the record of what we sent and when.
We do not collect sensitive information, and we ask you not to send it.
Why we collect it
To answer your enquiry. To assess whether we are a fit for your studio. To prepare proposals and agreements. To perform the services you engage us for. To invoice you and take payment. To meet our record-keeping duties under Australian tax and company law. To contact you about our services where you have agreed to that or where we have an existing business relationship with you.
We do not sell personal information and we do not display advertising.
Meeting recordings
Client meetings are recorded so the work has an accurate record behind it. We tell you before each recording starts.
Recordings are kept for the length of the engagement plus 12 months, then deleted. You can ask us to delete a specific recording at any time, and we will action that within 30 days unless the law requires us to keep it or a live dispute needs it.
Where we email you about our services, every email carries our name and contact details and a working unsubscribe link. Unsubscribing takes effect within 5 Business Days and we honour it permanently.
We build our contact list from studios we have approached directly, from enquiries we have received, and from current and former clients. We do not buy lists and we do not trade contact details with anyone.
Who we share it with
Our collaborators. Specialist designers, editors and producers engaged to work on your project. Each is bound by written confidentiality obligations.
Our service providers. The platforms we use to run the studio, being project and document management, file storage and email, our website platform, payment and banking, and social scheduling where your engagement includes it. These providers hold your information only to provide their service to us.
Where the law requires it. To a court, regulator or tax authority where we are legally obliged to disclose.
We do not disclose your information to anyone else without your consent.
Information held overseas
Some of our providers store information outside Australia, mainly in the United States and the European Union. We also engage a collaborator based in Brazil.
Before we send your information overseas we take reasonable steps to satisfy ourselves that it will be handled to a standard consistent with the Australian Privacy Principles. Where we cannot, we do not send it.
Cookies
Our website platform sets cookies needed for the site to function and to produce the basic analytics described above. You can block or delete cookies through your browser settings. Blocking them may affect how parts of the site work.
How long we keep it
Enquiries that do not proceed. Twenty-four months from your last contact with us, then deleted.
Client files and project materials. Your own copy of the completed work is yours to keep and does not expire. We hold a working backup and keep your client portal open for 12 months after your engagement ends. We remind you 60 days and 14 days before that window closes. At any point inside those 12 months you can ask us to re-supply your files and we will, at no charge.
After the portal closes we keep one archival copy, so that we can re-supply your work if you lose it and so we hold a record if a question about the engagement comes up later. Re-supply from the archive is free. You can ask us to delete the archival copy at any time by writing to admin@montenica.com, and we will action that within 30 days unless the law requires us to keep it.
Financial records. Five years, as required by Australian tax law.

Keeping it secure
We hold information on access-controlled accounts with two-factor authentication enabled. We never request or accept passwords or login credentials by email, including where you offer them. Where an engagement requires access to your platforms, we take delegated access through a management tool rather than your login details, and we remove that access when the engagement ends.
No system is perfectly secure. Where a data breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as required.
Getting access, and corrections
You can ask us what personal information we hold about you and ask us to correct anything that is wrong. Write to admin@montenica.com. We will respond within 30 days. There is no charge.
If we decline a request, we will tell you why in writing.
If you are in the United Kingdom or the European Union
Where the UK GDPR or the EU GDPR applies to our handling of your information, you also have the right to ask us to delete your information, to restrict how we use it, to receive a copy in a portable format, and to object to us contacting you.
Our lawful basis for contacting studios about our services is legitimate interests, being business-to-business marketing to a professional contact at their work address. Our lawful basis for performing an engagement is the contract between us.

Complaints
If you think we have mishandled your personal information, write to admin@montenica.com and tell us what happened. We will respond within 30 days.
If you are not satisfied with our response, you can take the matter to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
Changes to this policy
We update this page when our practices change. The date at the top tells you when it last changed.
